AUSTIN, Texas (AP) — Whole Foods Market Inc. on Wednesday reported earnings that rose by 6.3 percent in its fiscal third quarter, but its stock fell after sales missed Wall Street estimates. The company said revenue rose 10 percent to $3.38 billion from $3.06 billion in the same quarter a year earlier, and missed Wall Street forecasts. Analysts expected $3.4 billion, according to Zacks.

NEWARK, N.J. (AP) — A federal judge has dismissed a lawsuit filed by the operator of the largest marine container terminal in the New York area against the Port of New York and New Jersey. Maher Terminals has operated at the Elizabeth-Port Authority Marine Terminal for more than 60 years and leases a 445-acre terminal from the Port Authority that it uses to load and unload cargo containers. The company paid about $22 million in basic rent in 2012, according to court documents.
